Federal Court Orders Freedom of Abrego Garcia from ICE Detention
A federal judge has ordered the prompt release of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing detainment is without lawful basis.
"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," the judge wrote in her order.
The case stems from a erroneous deportation to El Salvador in March, which US authorities later admitted was an error. After his repatriation to the United States to face human smuggling charges, he was held in federal custody.
In her decision, the court noted that the government lacks a current deportation order, which prevents them from deporting Mr. Abrego Garcia "at this time."
